Prosecutions under Health and Safety Law present the most challenging and pressurised litigation any Local Government Lawyer can face, often involving cases of serious injury, sometimes fatalities and often conducted in the glare of publicity. Opponents will frequently be large national law firms and leading counsel.

The stakes are high and they can come up with little or no warning. They are unique in that Local Authorities are frequently not just the Prosecutors but can also be the Defendants.

A good knowledge of Health and Safety law is an essential part of any Local Government Lawyers “toolkit”.

This Course aims to help delegates to:

  • Understand key principles of H&S law in context of bringing a prosecution.
  • Understand where more detailed law, i.e. Regulations, can be found and how it applies
  • Advise an ongoing investigation
  • Review and charge offences
  • Prosecute the case to the Sentence hearing
