This course is essential for anyone who is interested in the development process including highways engineers, planning officers, surveyors and lawyers.

This course will help you to:

  • Understand the key planning concepts that relate to highways matters
  • Understand the different types of highway agreements and key practical and drafting points
  • Learn from the expert highways and planning lawyer and popular trainer, Tom Graham. Tom is the author of the book ‘Highways & Development’ (Bath Publishing, March 2019).

This course will cover:

  • Planning applications: overview of key planning procedures; identification of highway issues; highway matters as material considerations.
  • Planning conditions: how they can cover highways matters. "Grampian Type conditions". When are conditions defective?
  • The Advance Payments Code: a brief overview.
  • Section 38 agreements: what do they do? Problem areas. Drafting tips. Bonding agreements. The "dedication" and "adoption" of highways.
  • Section 278 agreements: often talked about but rarely understood. What do they cover? What are the Highway Authority’s obligations? The "Powergen" case. What is the inherent conflict between developer and the Highway Authority and how can it be managed?
  • Indemnities: it is essential that the local highway authority secures indemnities from the developer to cover not only third party claims but also statutory compensation, but this area is often overlooked.
  • Section 106 agreements: how can they cover highways issues? What are the key considerations?
