Target Audience

This course is suitable for those who are new to prosecution work with in a local Authority and/or within their first few years of practice. Delegates should already or intend to hold a Right of Audience in the Magistrates Court.

Course Content

  • Code of Practice for Prosecutors
  • Checking authorisations to prosecute and reviewing evidence
  • The decision to prosecute/other disposals
  • Identifying the Defendant and the correct offences
  • Drafting Informations/Summonses
  • Preparation for a hearing or trial
  • Objecting, handling and dealing with defence applications
  • Obligations of the defence advocate
  • Duties to the Court

The course will help delegates:

  • Feel confident with procedural issues
  • Understand the paperwork and the importance of preparation
  • Tackle weak cases with the client
  • Deal effectively with the defence
  • Fulfil their responsibilities confidently and correctly
  • See the case from beginning to end

This course will contribute to the following aspects of the SRA’s Statement of solicitor competence:

A Ethics, Professionalism and Judgment

A2 Maintain the level of competence and legal knowledge needed to practice effectively, taking into account changes in their role and/or practice context and developments in the law

A4 Draw on sufficient detailed knowledge and understanding of their field(s) of work and role in order to practice effectively

B4 Draft documents which are legally effective and accurately reflect the client’s instructions

B7 Plan, manage and progress legal cases and transactions
