Target Audience

The course aims to provide for delegates at all levels of experience as lawyers or technical officers. There will be plenty of time for asking questions during the course.

Course Content

The course aims to cover all the law which those working in the field of traffic regulation order, as well as their legal advisers, need to know in order to do their jobs that bit better.

    a. What needs an order? Bus lanes, traffic problems, one way systems, speed limits-when can the Traffic Authority consider making an order and what the law forbids.

    b. Orders for permanent changes on the highway-Road Traffic Regulation Act 1984 and other statutes.

    c. Temporary orders. When can these be made? How temporary is “temporary” and when can the order be effective at once?

    d. Special events. What can justify an order? Sporting and social events. -when can an order be made? The Town Police Clauses Act 1847. Common pitfalls.

    e. Drafting problems .What to do and when to do it. Common difficulties. Your problems discussed. What matters legally if drafting goes wrong.

    f. Procedure. Committee, cabinet or delegated powers. Advertising pitfalls. The involvement of councillors.

    g. Considering the objections-what to do and when to do it. Dealing with objectors. Advice to members. Lobbying by supporters and opponents.

    h. Confirmation. Public inquiry or not? Implementing the order.

    i. Challenging an order. The High Court. What’s involved.

    j. Case studies. Your questions answered.

This course will contribute to the following aspects of the SRA’s Statement of solicitor competence:
