This course will examine the key features of environmental impact assessments (EIA) in the planning system, focusing on the key policies on EIA, legislation and recent case law, development and screening. The course will cover the following:

  • Overview: background to and purpose of EIA
  • National policies on EIA, the NPPF; the NPPG
  • Relevant legislation and case law, including judicial review and EIA
  • Aspects of the environment which need to be considered
  • The type of development covered by the regulations
  • The meaning of Schedule 1 and Schedule 2 development
  • The meaning of Screening and Scoping
  • Preparing an Environmental Statement
  • Whether mitigation measures can be taken into account at the screening stage
  • When cumulative effects should be assessed
  • How multiple applications should be treated
  • Whether an applicant needs to consider alternatives

Target Audience

This course is aimed at planning lawyers, planning officers, environmental health officers and anyone working in local government dealing with environmental issues.

Competencies

This course will cover the following aspects of the SRA’s Statement of solicitor competence:
